1 Scope
The General Terms and Conditions (hereinafter referred to as “GTC”) apply to all legal transactions carried out via the online shop «www.biltong-house.ch» (hereinafter referred to as “online shop”). The online shop is operated by Weinguru GmbH (hereinafter referred to as “operator”).
The general terms and conditions apply exclusively.
Deviations from these conditions and any additional agreements are only binding for the operator if they are agreed in writing with the customer.
2 order
The order, including the order for the dispatch of the ordered goods, is deemed to have been placed and the order is deemed to have been accepted as soon as the customer has activated/accepted these General Terms and Conditions via the Internet using the checkbox “I accept the General Terms and Conditions” and has placed the order.
3 Prices and payment terms
All prices are in Swiss francs (CHF) including VAT.
The operator reserves the right to make price changes.
Such price changes have no effect on goods that have already been ordered.
Payment for the ordered goods by private customers is made either by advance payment, credit card or PayPal. Business customers can pay by invoice (due within 14 days of the invoice date).
In individual cases, the operator reserves the right to request payment in advance after receipt of the order.
4 delivery
The delivery area includes all of Switzerland and Liechtenstein.
The ordered goods will be delivered to the delivery address specified by the customer when ordering.
The delivery time is up to 5 working days against signature or deposit.
When delivering by deposit, the operator cannot accept liability in the event of loss or theft.
If delivery is not made within the above deadline, a grace period of 14 working days applies. If the delivery has not been received by the customer within this period, he has the right to withdraw from the order and receive a refund of the purchase price.
The operator assumes no liability for consequential damage due to delay in delivery.

5 Cancellation of product subscription
A product subscription can be canceled at any time after the first two deliveries have been automatically and successfully billed by email to «hello@biltong-house.ch» be terminated.
6 Warranty
In principle, the operator undertakes to only offer high-quality goods that meet all the requirements of Swiss law in the online shop and to publish correct data regarding the properties of the goods for sale.
If incorrect or defective goods were delivered, the customer must notify the operator within five working days of receipt of the goods by email at «hello@biltong-house.ch» or report the defect by post.
If this notification is made in a timely manner, the corresponding amount will be credited to the customer's account. If the originally ordered goods are no longer available, the purchase price and shipping costs (in the event that the customer only ordered the returned item) will be refunded to the customer.
7 Customer Obligations
The customer guarantees that he is authorized to conclude the contract in accordance with applicable law. It is the customer's responsibility to enter the correct delivery address. The customer must check the delivery within five working days at the latest. Damaged/incorrect delivery items must be kept at the disposal of the operator for return. The customer expressly authorizes the operator to pass on the order data entered to the relevant supplier who delivers the ordered goods. The data may also be used to send newsletters/promotions etc.
Any further use or distribution is excluded.
The customer authorizes the operator to create copies and electronic recordings (log files) of all transactions for proof.
8 Disclaimer
Any liability on the part of the operator and its assistants for direct or indirect damages, errors or other disadvantages that may arise from the use of the order or the purchase of the goods, which goes beyond that in section 5, is excluded - to the extent permitted by law.
9 Intellectual property rights
The customer acknowledges that all intangible rights to names/designations, designs, concepts and software associated with the website “www.biltong-house.ch” are the sole property of the operator, regardless of their ability to be protected under special law.
10 Data protection
All credit card data is transmitted using certified SSL technology (encryption technology) and secure e-commerce. The customer's credit card number is therefore always protected and is transmitted unreadable for third parties.

12 Choice of law and place of jurisdiction
This legal relationship is subject to Swiss law. The exclusive place of jurisdiction is the registered office of the operator.
